The Pitfalls of Binding Mandatory Arbitration

Beware of arbitration

While alternative dispute resolution, such as mediation and non-binding arbitration, can be helpful to resolve a legal conflict, binding arbitration clauses often strips unsuspecting consumers of their constitutional right to a trial by jury.

In many instances, these arbitration clauses force consumers to have their dispute resolved through a private judging mechanism bought and paid for by the big business with whom they are engaged in a dispute.
